Environmental Law Institute – West Virginia v. EPA: The EPA’s Climate Authority

On February 28th, the Supreme Court will hear oral arguments for the landmark West Virginia v. EPA case, involving the scope of powers delegated to the Environmental Protection Agency through the Clean Air Act. The Supreme Court’s decision will affect administrative law, as it will determine whether Congress has constitutional authority to delegate broad regulatory power to federal agencies.
