In November, 2013, EPA announced a highly contentious proposal that lowered the 2014 Renewable Fuel Standard targets below their 2013 levels. These targets apply to the amount of renewable fuels that are blended into the nation’s gasoline supply. A year later, EPA abandoned the proposal after significant push back from the renewable fuel industry, agreeing to reconsider the 2014 targets. EPA has yet to reissue the proposal. Senate Republicans recently unveiled the “Domestic Energy and Jobs Act,” an energy bill intended “To approve the Keystone XL Pipeline, to provide for the development of a plan to increase oil and gas exploration, development, and production under oil and gas leases of Federal land, and for other purposes.” Sen. The U.S. Commodities Futures Trading Commission (CFTC) has issued their final definitions of financial products regulated under the Dodd-Frank Act. The rule maintains that forward contracts, which cover delivery of physical goods and, according to Platts, currently constitute most energy market trades are not swaps, which are purely financial exchanges. Examples of forward contracts in energy markets include environmental commodities, peak supply contracts, tolling agreements and many natural gas supply contracts.
